Halle Berry seeks to modify and reduce monthly child support payments

Many Chicago area residents have likely seen at least one movie starring actress Halle Berry. According to IMDB, the Oscar-winning Berry has appeared or starred in nearly 50 television episodes and movies, including the 2001 drama Monster's Ball for which Berry became the first African American woman to win in the leading actress category.

While Berry's accustomed to being in the news for professional reasons, in recent years, the actress has made headlines for issues related to her personal life and ongoing disputes with ex-boyfriend Gabriel Aubry.

Berry and Aubry, a successful male model, med in 2005 and went on to have a daughter together in 2008. When the couple split in 2010, a bitter child custody battle followed in which a judge eventually awarded joint physical custody to both parents. At that time, Berry was also ordered to pay Aubry $16,000 per month in child support payments.

According to the child support order, Berry is required to pay Aubrey monthly payments in the amount of $16,000 until the former couple's daughter, who is six, "turns 19 or graduates from high school." Berry, however, recently filed a petition to modify and reduce Aubry's monthly child support payments by $13,000, to just $3,000. 

In her court petition, Berry asserts Aubrey is intentionally choosing to not work and instead living off of the child support money that's intended to benefit the couple's daughter. The petition goes on to cite examples of Aubry using child support money for his personal use on clothing, a gym membership, his car and to pay his health insurance.

In this case, a judge has yet to rule on whether to award the reduction in child support payments. Such petitions for modifications and reductions in child support are fairly common and often reflect the changing financial circumstances of one or both parents. Chicago area parents who are dealing with child support issues would be wise to seek the advice and assistance of a family law attorney.
