Going Through a Divorce? Why You Should Not Represent Yourself

Divorces can be expensive. That is why many people choose to represent themselves in divorce proceedings but when is that not a good idea?

1. You have children and you cannot agree on who they will live with or even how much time each of you will spend with them.

2. Your spouse has a retirement account. Whether it is a pension or a 401(k), you have a marital claim to that account and dividing it will require a special court order.

3. You or your spouse may qualify for maintenance or what we used to call alimony which under current Illinois Law is calculated by 30% of his or her gross minus 20% of your gross income unless the two of you agree to waive such claims or want to negotiate some lesser amount.

4. The two of you purchased real estate during your marriage. You may or not know that you are normally entitled to at least 50% of the net equity in the home or condo. There should be some deadline for sale or refinance so you get your fair share.

5. One of you owns a business or stock options which may or may not entitle you to a portion.

6. You had a prenuptial agreement and you want to ensure it is followed or in the alternative you feel there is some basis to challenge it.
